Failure to Diagnose
In Kentucky, every physician has a duty to provide the skill, care, judgment and knowledge rightfully expected of a prudent doctor. This certainly includes diagnosis of a patient's medical condition. A failure to properly diagnose the patient's disease may prevent a patient from receiving necessary and beneficial treatment. If a doctor misses a diagnosis, or makes an incorrect diagnosis, and that failure by the doctor causes a patient to suffer serious adverse consequences which likely would have been avoided if a proper diagnosis had been made, the patient may well have a claim against the physician for the resulting injury. In addition, if a physician makes an incorrect diagnosis which puts a patient in the position of undergoing unnecessary harmful medical treatment, the patient may well have a claim for the resulting harm. For instance, if a doctor diagnoses a patient with cancer, and in reality the patient does not have cancer, but because of the wrong diagnosis the patient undergoes radiation therapy and chemotherapy, and is harmed by the treatment, the patient has a claim for the harm caused by the unnecessary treatment.
